The Reserve Bank governor Michele Bullock has said that “some pain now will prevent even worse pain down the track”, after lifting official interest rates to an 18-year high of 4.85% in a bid to combat persistent inflation.

The RBA’s decision to hit mortgage holders for a fifth time in 2026 will intensify pressure on indebted households, but there were signs that the central bank will at least now wait through summer to gauge the impact of higher interest rates on the economy.

Justice department had ordered state to segregate and not count 20,000 ballots from people it claims are non-citizens

The supreme court on Monday ruled against the Trump administration and its attempts to force California election officials to segregate and not count ballots from people that the justice department claims are non-citizens. The ruling follows several lower courts siding with California officials, who argued the federal government was seeking to interfere in state elections.

The court did not issue an explanation for its ruling, which is customary in cases that come to it on an emergency basis. There were no noted dissents from the justices.

Strikes on eve of US midterms reportedly target surface-to-air missiles being used against US assets

The ⁠US launched limited strikes on ​Iran’s Qeshm Island late on Monday, hours after the vice-president, JD Vance, said he was optimistic that diplomatic efforts to end the war were moving in the right direction.

The strikes, disclosed by Iranians on social media and confirmed by US Central Command (Centcom), came on the eve of crucial midterm elections in which Donald Trump’s Republican party is expected to be punished by voters. Diplomatic mediators believe it will be clear within two days whether the basis for continued indirect talks between the US and Iran exists.

В предыдущем посте я рассказала о новых правилах IT-аутсорсинга на финансовом рынке, предусмотренных законом. Но есть еще одна сторона этих изменений, не менее интересная для IT-компаний, - договорные риски.

Представим ситуацию. IT-компания обслуживает информационные системы банка, имеет доступ к банковской тайне и персональным данным клиентов. Произошел инцидент, часть информации раскрыта, банк понес расходы и предъявил требования подрядчику.

Кто и за что будет отвечать?

Закон прямо предусматривает обязанность поставщиков услуг и их должностных лиц сохранять банковскую тайну, а за ее разглашение - ответственность, включая возмещение причиненного ущерба.

Но это не означает, что любые расходы банка автоматически можно взыскать с IT-компании. По общим правилам ГК РФ необходимо учитывать основание ответственности, нарушение обязательства, причинную связь и размер убытков. А также то, какие обязанности по защите информации приняла на себя каждая сторона.

Например, подрядчик отвечает за безопасность своей инфраструктуры, но банк самостоятельно управляет правами доступа отдельных пользователей. Если инцидент произошел из-за ошибочных действий сотрудников банка, вопрос об ответственности исполнителя уже не так очевиден.

Поэтому особенно опасны договоры, в которых подрядчик отвечает за любые инциденты и все их последствия независимо от причин возникновения.

Еще один момент - обязанность оперативно сообщать об инцидентах. Само уведомление не решает проблему. Важно определить, кто расследует происшествие, обеспечивает сохранность доказательств, устраняет последствия и взаимодействует с регулятором. Иначе после инцидента стороны могут потратить больше времени на выяснение, кто что должен делать, чем на устранение самой проблемы.
